Arena Usage Agreement
Between
Western Ball Hockey League Ltd., hereby known as the “WBHL”
And
The renting body, hereby known as the “User”
Terms of Use
The term of this agreement is for the specified booked time(s) only. In the event of a disagreement, The WBHL and its staff will refer to the computer system booking calendar.
Respect & Maintenance of The Facility
The User agrees to act in a respectful manner while occupying any court, field, change room or common areas located on the facility grounds. All users will remove their belongings and clean up any garbage immediately after the use of any court, field, change room or common area. Failure to maintain the facility in a reasonable condition may result in the forfeiture of future booking deposits and times.
Insurance
The User agrees to provide their own insurance coverage at their sole cost.
Fees & Deposits
All bookings up to and including $1000 require a 50% non-refundable deposit at the time of the booking. Bookings over $1000 will require a flat $500 non-refundable deposit per season. Cancellations and changes will not be accepted less than 42 days (6 weeks) prior to a booking calendar month. All changes are subject to availability. The amount of each season’s bookings will be totaled and the client will have the choice to make either monthly or weekly automatic payments by credit card or online invoicing through PayPal. If credit card or PayPal payments are not an option for the User, the full payment will be due in full at the time of booking. For reference in this agreement, “the rental date” will refer to the day and time of the facility usage, as requested by the User at the time of the initial booking. Under no circumstances will any booking be secured without payment.
Compliance With Laws
The User shall comply with all applicable municipal, provincial, and federal laws at all times while on the facility grounds. Failure to comply with any law will result in the immediate removal of the User and full forfeiture of current and future bookings as well as any deposit or monies paid associated with those bookings.
Advertising/Selling
The User shall not sell or advertise goods or services on the grounds of the facility at anytime without the prior written permission by the WBHL. The User shall not take any audio or video recording on the grounds of the facility without prior written permission by the WBHL.
Capacity
The User will ensure only a reasonable amount of people will occupy any common area, change room, court, field or other area of the facility to ensure adequate access to fire and emergency exits and will assist with removing excess people at the request of WBHL staff.
Defacement & Damage
The User will be responsible for all costs incurred by the facility with regards to defacement and damage by the User outside of regular wear and tear.
Additional Users
It is understood that the facility may occupy other user groups at any time. The User will not cause interference to other users and will act reasonably so as to allow all users to have an enjoyable time.
Parking
The WBHL is not responsible for vehicle damage or theft while on the grounds of the facility. The User will park respectfully and follow all demarcation lines.
Smoking/Alcohol Restrictions
By this agreement, The WBHL denies any right to the User of possession or consumption of alcohol or tobacco products on site. Dispensing and consumption of alcoholic beverages is prohibited on the facility grounds.
Violations
Breaches of this agreement by the User will result in a termination of future bookings and a full forfeiture of deposits associated with those bookings and may result in additional fines or fees to the User.
Indemnification
The User shall indemnify and hold The WBHL, its executives, employees and officers harmless from any claim, suit, or proceeding arising out of subject matter of this agreement including the use of the facility. The User shall also indemnify The WBHL, its executives, employees and officers for all expenses, including reasonable legal fees incurred in defending such claims.
No Assignment
The User shall not assign or transfer any of its rights under this agreement without prior written consent by an executive of the WBHL.
